18 classes, one that's right for you
In Malta, all commercial properties fall under one of 18 defined use classes, covering everything from agriculture and industry to tourism and aquaculture. For most businesses opening a shop, office or food outlet, the relevant category is Class 4 — Commercial Use.
Class 4 is divided into four sub-classes, each with a precise and legally defined purpose. Understanding which one applies to your business before you commit to a property is essential.
The four Class 4 sub-classes
Financial, Professional & Other Offices
Use for:
- Financial services
- Professional services (doctors, lawyers, dentists)
- Any other comparable office use
Retail
Use for:
- Retail outlets
- Display for sale of goods (excluding motor vehicles)
Food & Drink — No Cooking
Use for establishments selling hot or cold food or drink for consumption on the premises, where no cooking is permitted.
- Cafés, juice bars, delis
- Take-away with no cooking on site
Food & Drink — Cooking Allowed
Use for establishments selling hot or cold food or drink for consumption on the premises, where cooking is permitted.
- Restaurants, bars, kitchens
- Any food business requiring cooking facilities
Getting the class wrong is an expensive mistake
Each sub-class has a very specific, legally defined purpose. If your business activity doesn't match the class of your premises — for example, operating a restaurant in a 4A office space — you cannot legally trade. Changing the classification requires permits, time and significant costs. Always verify the class before signing a lease.
